Summary
TTCpanel.ca was developed to provide the general public a way to provide relevant feedback to the Customer Service Advisory Panel online. Our terms of service are designed to ensure that it is used as designed.
Your data is always private and confidential. The Customer Service Advisory Panel will not store or use your personal data for purposes unrelated to the purposes of the role of the Customer Service Advisory Panel. Your personal data (Name, email, and feedback) will not be released to third parties and will not be stored electronically after December 31, 2010. Your information will never be divulged or sold to parties unrelated to the Customer Service Advisory Panel’s purpose.
In providing feedback through TTCpanel.ca, the information you provide will be made visible to the Customer Service Advisory Panel and any third parties involved with the Customer Service Advisory Panel’s purpose and intent, including but not limited to the Toronto Transit Commission and its affiliates.
These Terms of Use form a legally binding agreement between you and the Customer Service Advisory Panel.
Definitions
1. “Intellectual Property Rights” means copyrights (including copyright applications), trade secrets, trademarks, moral rights, know-how and any other similar rights or intangible assets recognized under any law(s) or international convention(s) in any country or jurisdiction in the world where such rights are applicable.
2. “Customer Service Advisory Panel” means the independent panel advising the Toronto Transit Commission on various aspects of customer service in 2010, including members Steve O’Brien, Matthew Blackett, Robert Culling, Yves Devin, Tyson Matheson, Dr. Roy Morley, Sue Motahedin, Krisna Saravanamuttu, Kripa Sekhar, and Julie Tyios.
3. “Terms” means these Terms of Service and Privacy Policy;
4. “Web site” means any Web site operated by or on behalf of the Customer Service Advisory Panel and through which Services are provided to you;
5. “Service” means the feedback forms provided through TTCpanel.ca for the purposes of collecting feedback from the general public to be reviewed by the Customer Service Advisory Panel;
6. “You” or “your” means anyone who accesses or uses the Services.
1. User Application and Acceptance
1.1. Unless otherwise agreed in writing with the Customer Service Advisory Panel, these Terms apply to your use of the Web site, including the suggestion form.
1.2. You may not use the Web site if you do not accept the Terms.
1.3. The Terms shall be deemed accepted by you upon the earlier of your: (i) using the Web site; or (ii) clicking to accept or agree when this option is made available to you in the course of accessing or providing feedback through the Web site.
1.4. The Customer Service Advisory Panel may make changes to the Terms of Use and Privacy Policy from time to time, and the Customer Service Advisory Panel will make the new terms available at this web address. You understand and agree that you are responsible for checking this address to determine whether the Terms have been updated and, in any event, that if you use the Web site after the date on which the Terms have changed, you are deemed to have affirmatively accepted the updated Terms.
2. The Services
2.1 Subject to the Terms, you may access and use this web site to provide feedback through a web-based form that will make information freely accessible to the Customer Service Advisory Panel and any affiliated parties.
2.2 The Customer Service Advisory Panel is providing this web site as a means to submit feedback online to the Customer Service Advisory Panel, and not to solicit information or services.
2.3 The Customer Service Advisory Panel provides personal, worldwide, non-exclusive access to the feedback form as intended as part of the Services provided to you by the Customer Service Advisory Panel, subject to the Terms at all times.
2.4. You agree to provide accurate feedback in good faith should your chose to partake in the Web site’s feedback Services, in relation to the TTC and its affiliated parties regarding various aspects of TTC customer service and other related areas of concern.
3. Access
3.1. This Web site is freely available for use to all parties who have access to the Internet.
3.2. To submit information through the suggestion form, you must provide your legal name and an email address that is attributed to your person as a means of verifying your identity. The suggestion form operates on the basis of good faith and the Customer Service Advisory Panel will not take responsibility for false or misleading submissions by way of identity or feedback, and will not be responsible for any consequences arising from false or misleading submissions.
4. Acceptable Use
4.1. To report use contrary to these Terms, please email: info@ttcpanel.ca.
4.2. You shall at all times act reasonably and in good faith when using the Web site and shall not:
1. abuse, harass, threaten, impersonate or intimidate any person or any third party;
2. interfere or attempt to interfere with the proper functioning of the Web site;
3. post or transmit, or cause to be posted or transmitted, any material that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive, profane, or otherwise violates any law or right of any third party;
4. use the Web site to advertise to, or solicit, any involved parties to buy or sell any products or services; or
5. post, transmit, share, or otherwise make available content that, in the sole judgment of the Customer Service Advisory Panel:
1. is objectionable or which restricts or inhibits any other person from using or enjoying the Web site, or which may expose TTCpanel.ca or its users to any harm or liability of any type;
2. that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, provincial, state national or international law;
3. that would constitute unsolicited or unauthorized advertising, solicitations, promotional materials, or any other form of solicitation.
5. impersonate any person or entity or falsely state or otherwise misrepresent yourself, your name, email address or your affiliation with any person or entity.
5. Content and Privacy
5.1. This document contains all information about TTCpanel.ca’s privacy rights and data collection.
5.2. You agree that you are solely responsible for (and that the Customer Service Advisory Panel has no responsibility to you or to any third party for) any Content that you create, transmit or display while using the Web site and for the consequences of your actions (including any loss or damage which the Customer Service Advisory Panel may suffer) by doing so.
5.3. Subject at all times to the TTCpanel.ca Terms of Use and Privacy Policy, by submitting, posting or displaying the Content you grant the Customer Service Advisory Panel a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to reproduce, adapt, modify, translate, publish, publicly perform, publicly display and distribute such Content.
5.4. Any Content you send or otherwise make available through use of the Web site, including but not limited to, sending feedback requests or feedback responses is done so at your own risk. The Customer Service Advisory Panel cannot control the actions of other users with whom you may chose to share any information and cannot and does not guarantee that Content you send or otherwise make available will not be viewed by unauthorized persons. You shall be solely responsible for your own Content and the consequences of posting or publishing it. In connection with your Content, you affirm, represent and warrant, in addition to the other representations and warranties in this Agreement, the following: (i) your Content and the Customer Service Advisory Panel’s use thereof as contemplated by this Agreement and the Service will not infringe any rights of any third party, including but not limited to any Intellectual Property Rights, privacy rights and rights of publicity.
5.5. It is the Customer Service Advisory Panel’s strict policy not to publish or otherwise release the identity of the Users, except as provided for in the Terms.
6. Third Party Sites.
The Web site may include hyperlinks to other web sites or content. You acknowledge and agree that the Customer Service Advisory Panel is not responsible for the availability of any such external sites or resources, and does not endorse any materials on or available from such Web sites or resources. You acknowledge and agree that the Customer Service Advisory Panel is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such Web sites or resources. The Customer Service Advisory Panel encourages you to be aware of when you leave the Web site, and to read the terms and conditions and privacy policy of any third-party website or service that you visit.
7. Miscellaneous
7.1. The Terms will continue to apply for as long as you, the user, make use of the TTCpanel.ca Web site and any or all of its features and functionality.
7.2. The Customer Service Advisory Panel has implemented reasonable technical and organizational measures designed to secure your personal information and your Content unauthorized access, use, alteration or disclosure. However, the Customer Service Advisory Panel cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information and your Content for improper purposes. You acknowledge that you provide your personal information at your own risk.
7.3. The Terms constitute the whole legal agreement between you and the Customer Service Advisory Panel and govern your use of the TTCpanel.ca Web site.
7.4. The Customer Service Advisory Panel makes no representations that the Web site is appropriate or available for use in other locations other than Canada.
7.5. You agree that: (i) the Web site shall be deemed solely based in the Province of Ontario, Canada; and (ii) The Terms, and your relationship with the Customer Service Advisory Panel under the Terms shall be governed by the internal substantive laws of the Province of Ontario, without respect to its conflict of laws principles.
7.7. The Customer Service Advisory Panel may provide notifications, whether such notifications are required by law or are for authorized marketing or other business related purposes, to you via email notice, or through conspicuous posting of such notice on our website, as determined by the Customer Service Advisory Panel in its sole discretion. The Customer Service Advisory Panel reserves the right to determine the form and means of providing notifications to Users, provided that you may opt out of certain means of notification as described in these Terms.
7.8. These Terms and all representations, obligations, undertakings and warranties contained in it shall ensure for the benefit of any successor and/or assignees of the Customer Service Advisory Panel.
